1. Acceptance of Terms

By creating an account, accessing, or using any part of the MediConsult platform (“Platform”), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you must not use our services.

2. Description of Services

MediConsult provides a telemedicine platform that connects patients with licensed healthcare providers for virtual consultations. Our services include:

• Video and audio consultations with healthcare providers
• Secure messaging with healthcare providers
• Electronic prescription services
• Medical record storage and management
• Appointment scheduling and management
• Health assistant and triage services
• Pharmacy integration for medication delivery

3. Eligibility

To use our services, you must:

• Be at least 18 years of age, or have parental/guardian consent
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Be located in a jurisdiction where telemedicine services are permitted
• Have access to a device with internet connectivity for video consultations

4. User Accounts

4.1 Account Registration

You must create an account to access our services. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

5. Healthcare Provider Services

5.1 Provider Verification

All healthcare providers on our platform are verified licensed professionals. We verify medical licenses, credentials, and qualifications before allowing providers to offer services.

5.2 Scope of Services

Telemedicine consultations are suitable for many but not all medical conditions. Providers will determine if your condition is appropriate for virtual care. If in-person care is needed, providers will refer you accordingly.

6. Fees and Payment

Consultation fees are displayed before booking and must be paid in full at the time of scheduling. Payment is processed through secure third-party payment processors.

6.1 Refund Policy

• Full refund for cancellations made 24+ hours before appointment
• 50% refund for cancellations made 2-24 hours before appointment
• No refund for cancellations made less than 2 hours before appointment
• Full refund if provider cancels or is unavailable

7. Prescriptions

Prescriptions are issued at the sole discretion of the healthcare provider based on their medical judgment. Not all consultations will result in a prescription. Controlled substances may have additional restrictions based on applicable laws and regulations.

8. Prohibited Conduct

You agree not to:

• Provide false or misleading information
• Use the platform for fraudulent purposes
• Attempt to obtain prescriptions inappropriately
• Share your account credentials with others
• Record consultations without express consent
• Harass or abuse healthcare providers
• Interfere with platform operations
• Violate any applicable laws or regulations

9. Intellectual Property

All content, features, and functionality of the platform are owned by MediConsult and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any content without our express permission.

10. Limitation of Liability

To the maximum extent permitted by law, MediConsult shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Our total liability shall not exceed the amount you paid for the specific service giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless MediConsult and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the platform or violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may terminate your account at any time by contacting our support team.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or platform notification. Continued use of the platform after changes constitutes acceptance of the modified Terms.
